Syrian army pledges 4-day truce amid rebel gains

BEIRUT (AP) ? The Syrian army promised to observe a four-day cease-fire for a Muslim holiday starting Friday, while rebels claimed to have taken control of new areas in the key battleground of Aleppo.

In the announcement read Thursday on state TV, the army granted itself significant loopholes, saying it will respond to rebel attacks or efforts to bolster their positions as well as the entry of fighters into Syria from neighboring countries.

The call for a four-day cease-fire for the Eid al-Adha holiday is currently the international community's only idea on how to try to stop 19 months of violence in Syria. International envoy Lakhdar Brahimi proposed the idea, saying he hopes it will lead to a longer term cease-fire and negotiations between the sides. Brahimi represents the U.N. and the Arab League.

Rebels fighting to topple the regime of President Bashar Assad have no unified command, and rebel reaction to the idea ranged from skepticism that the government would keep its promises to outright refusal.

Abdelbaset Sieda, head of the main opposition group in exile, the Syrian National Council, said he had little faith the regime would hold its fire, but that rebels would respond accordingly.

"We are awaiting the regime side. If they accept it, we will accept it also," he said by phone.

Rebel commanders inside Syria have said in recent days that they did not plan to stop fighting.

The cease-fire pledge came amid rebel claims of major advances in Syria's largest city on Thursday, with the rebels claiming to have seized area long controlled by the regime.

The two sides have been stalemated for months in the fight for Aleppo.

Activists in Aleppo reported heavy clashes citywide on Thursday, particularly around a military airport. Bassam al-Dada, a rebel spokesman, said in a phone interview that anti-regime fighters have taken several areas that have seen months of clashes, including the southwestern neighborhoods of Salaheddin and Suleiman a-Halabi.

Rebels also moved into the northern Kurdish neighborhood of Ashrafiyeh for the first time and were fighting in the areas of Arqoub, Siryan, Zahra and Firqan, al-Dada said.

He said rebels now control more than half of the city and were fighting for control of Aleppo's strategic military base of Nairab.

The Syrian government made no immediate comment on the Aleppo fighting, and rebel forces have often pushed into new areas in the past, only to swiftly withdraw when faced with Assad's air power.

It was unclear if the rebels have the forces to hold the new areas.

An Aleppo activist reached via Skype also said rebels had seized Ashrafiyeh, a Kurdish neighborhood where residents of other city neighborhoods had sought refuge from the fighting.

The activist, who goes by the name of Abu Raed because of security concerns, said the rebels are moving into the neighboring Al-Siryan Al-Jadideh, a Christian area.

"It was a surprise," Abu Raed said on Skype. "It was fast progress and in an unexpected direction."

Abu Raed said he had no information on people killed or wounded in the fighting, but the Britain-based Syrian Observatory for Human Rights said 9 people were killed and 15 wounded when mortars fell on Ashrafiyeh. It said it was unclear who fired them.

Activist also reported heavy shelling and clashes in various rebel districts outside of Damascus, the capital.

Also on Thursday, the deputy head of the United Nations, Jan Eliasson, warned that there are no guarantees that a proposed Syrian cease-fire would hold but urged Syrian rebels and the regime in Damascus to observe it.

"We all have our eyes on the tragedy in Syria, and we pin our hopes now on the cease-fire that hopefully can take place," he told reporters in Geneva.

Previous cease-fire missions have failed, in part because neither Assad nor rebels trying to topple him had an incentive to end their bloody war of attrition. Both sides believe they can still make gains on the battlefield even as they are locked in a stalemate, and neither has faith in negotiations on a political transition.

Al-Dada said the regime could not be trusted.

"Our people have no truce. They have been subjected to massacres," he said.

Alien hunting: Don't rule out finding DNA on Mars

No one has looked for life on Mars for more than 30 years, ever since NASA's Viking missions sent back inconclusive results. Genomics maverick Craig Venter wants to change that. Cracker of the human genome and builder of synthetic life, Venter announced at the Wired Health Conference in New York last week that he wants to send a DNA sequencer to Mars and beam back the genomes of any alien microbes.

Details of this ambitious plan are slim, and Venter has declined to elaborate. But there is reason to think Mars DNA can be found ? if we know how and where to look.

Previous hunts for life, including the experiments on the Viking landers, looked for organic molecules on Mars's surface. The results have been plagued by ambiguity, especially in the light of growing evidence that organic molecules can be formed by natural processes that do not involve life.

Finding DNA would be a much more direct indicator of life, and there is a chance it is out there. The precursors to ribose ? the sugar found in DNA and RNA ? have been detected in interstellar space, and complex organic molecules have been found on Saturn's moons Titan and Enceladus. Life's raw materials could have spread throughout the early solar system, and life may have emerged several times from a common set of ingredients.

Alternative chemistry

It's also possible that life hitched a ride between Earth and Mars in their early days. Asteroid impacts have sent about a billion tonnes of rock careering between the two planets, potentially carrying DNA or its building blocks. That could mean that any genetic material on Mars is similar enough to DNA that we have a chance of finding it using standard tests.

Even if we don't, we can set up future sequencers to look for molecules that use alternative sugars or chemical letters in the genetic code. "We're not there yet, but it's not a fundamental limitation," says Chris Carr of the Massachusetts Institute of Technology, who works on the NASA-backed Search for Extraterrestrial Genomes.

Another option is for a DNA sequencer to piggyback on an organics-hunting suite. Searching only for DNA as we know it means we might miss alternate life-forms, says Michael Meyer, lead scientist for NASA's Mars Exploration Programme. A sequencer could follow up on an organics find by looking for DNA and testing whether any found has earthly origins.

Secret tunnels

Since Viking, though, NASA has mostly played it safe, scouring Mars's surface not for the chemical signatures of life but for ancient habitable environments ? the goal of the Curiosity rover. NASA has gone this route because Mars lacks a thick atmosphere and protective magnetic field, so it is exposed to damaging ultraviolet light and cosmic rays. Any life would have to be shielded under at least a metre of soil or rock to survive. What's more, recent work has shown that DNA breaks down at a predictable rate. That rules out any genetic traces more than a million years old surviving.

Venter's plan would need to target more fertile hunting grounds deeper inside Mars. Luckily, the technology to do that may already exist. The European Space Agency's ExoMars mission, slated to launch in 2018, will have a drill that will delve at least a metre deep. Robot explorers might also aim for lava tubes, tunnels excavated by ancient volcanic flows and shielded from radiation. NASA's Jet Propulsion Laboratory is already developing a rover called Axel that can abseil down cliffs and could head into a Martian cave.

If a DNA sequencer is flight-ready when the next Mars rover launches, would NASA consider adding it in? "Of course," Meyer says. "It certainly is a worthy cause."

Egg Freezing Enters Clinical Mainstream

The American Society for Reproductive Medicine has issued guidelines, which effectively green-light the procedure for fertility clinics

Egg freezing is no longer an experimental procedure, according to the American Society for Reproductive Medicine (ASRM), which on 22 October issued new guidelines on the controversial practice. The change in policy is expected to accelerate the growth of clinics that offer egg freezing to women who face fertility-damaging treatment for cancer or other conditions, and to women wishing to delay having a baby ? although the society stopped short of endorsing the procedure for that purpose.

More than 900 babies have been born using the technique, which the ASRM called ?experimental? in 2008. With that designation, the society approved of the use of egg freezing only in clinical trials overseen by an institution review board (IRB). Despite the ASRM policy, clinics have increasingly been offering the technique outside of this framework as a clinical service for a fee. Now the society is effectively giving such clinics a green light, a development that is likely to encourage consumer groups advocating for insurance providers to cover the procedure.

?This will open up the procedure for many, many people,? says Samantha Pfeifer, an associate professor of obstetrics and gynecology at the University of Pennsylvania, in Philadelphia, who headed the committee charged with making the recommendation. She adds, ?There are enough preliminary data to say that this technique is safe.?

The committee removed the ?experimental? label after analyzing more than 100 studies assessing the health of eggs after the procedure and the outcome of births. The committee concluded that there have been no reported increases in chromosome abnormalities or birth defects among children born using oocyte cryopreservation, the technical term for the procedure.

But the committee also noted that the data so far are incomplete ? only four randomized clinical trials have been conducted using the technique. And while those studies suggest that the technique results in successful pregnancy in young women at the same rate as assisted reproduction with ?fresh? oocytes, observational studies suggest the success rate is lower. Because the technique of freezing the large and fragile cells is relatively new, nothing is known about long-term effects on offspring that result from the method. Some studies suggest that babies born using assisted reproductive technologies are at an increased risk for certain rare disorders ? the neurological condition Angelman syndrome, for example ? that result from changes in the chemical modifications to DNA known as ?epigenetic marks?.

The safety and success rates of the procedure have been the focus of heated debates among reproductive biologists. At the ASRM annual meeting in San Diego this week, for instance, Pfeifer will be facing off against Nicole Noyes, head of a clinic affiliated with New York University that offers the procedure. The topic will be whether younger women should consider freezing their eggs for the future, says Pfeifer.

Despite the need for more research, the new guidelines will help clinicians counsel patients about the technique?s safety and potential to result in a pregnancy, says Theresa Woodruff, chief of the Division of Fertility Preservation at the Feinberg School of Medicine at Northwestern University in Chicago, ?It?s a good, measured step,? she says. The society announced its new policy on 19 October and published its new report yesterday in the journal Fertility and Sterility.

There were not enough data for the committee to recommend the procedure for women nearing the end of their reproductive years who wish to preserve their eggs for future use, says Pfeifer. And the data so far suggest that the success rates of the procedure decline with maternal age. Nonetheless, the use of egg freezing for delaying reproduction is a potentially huge growth area ? many clinics are already offering these services.

Obama Diagnoses Romney with "Romnesia" on Campaign Trail

President Barack Obama made a campaign stop at George Mason University on Friday that made headlines for his use of the social media term "Romnesia" to describe Republican challenger Mitt Romney's approach to political issues. (AP) ? A Russian-made Soyuz rocket was erected into place Sunday, ahead of the start of a mission to take a three-man crew to the International Space Station.

Of the three men blasting off Tuesday, only Ford has spent any time in orbit. He spent two weeks in space as pilot of the space shuttle Discovery in 2009 on a mission to transport scientific equipment to the ISS.

NASA's Tom Marshburn, Canadian astronaut Chris Hadfield and Russian cosmonaut Roman Romanenko will join the station in December, taking the place of Williams, Malenchenko and Hoshide, who are due to return to earth next month.

Lawyers, CEOs boosted Obama's Sept. donations

(AP) ? Attorneys, business owners and retirees were among those who helped President Barack Obama maintain slim fundraising supremacy over Republican challenger Mitt Romney last month, with the president raising $181 million as he entered the last full month in the fight to keep his job.

An Associated Press review of newly released financial reports found at least $11 million from lawyers and at least $3 million from investors and bankers, some of whom cooled to the president earlier this election when critics say he cracked down on Wall Street and pushed for consumer-protection reforms. About $22 million more came from retired Americans, an important bloc of voters likely more tuned in to health care reform and changes in retirement benefits.

Their contributions, among hundreds of thousands, went hand-in-hand with record donations to an outside political group helping Obama win a second term. Still, the president began October with less available money to spend than Romney, as Obama's campaign, the Democratic Party and related groups reported $149.8 million cash on hand. That's compared with $183.1 million in the bank among Romney's campaign, the GOP and his joint-fundraising apparatus.

All told, a swath of small-dollar contributions helped Obama and the Democratic Party best Romney and the GOP by more than $10 million last month after being repeatedly walloped in the money race earlier this year. The president's fundraising haul topped the more than $114 million he and the Democrats raised during the month of August, and the cash Obama pulled in last month was slightly less than his record-breaking $190 million from September 2008.

Financial support to Obama and Romney are putting the presidential election on track to cost nearly $2 billion, thanks to mountains of cash earmarked to both campaigns and independent "super" political committees working on their behalf. Wealthy Americans are increasingly picking up the tab this year, at times giving millions of dollars apiece to super PACs that have buoyed costly advertising.

September's reports show major financial support going to both Republican and Democratic super PACs, with the pro-Romney Restore Our Future PAC reporting it collected $14.8 million in September, the group's second-most lucrative month. Late Saturday, American Crossroads, the major super PAC headed by GOP strategist Karl Rove, reported $11.6 million for September, the highest single-month total for the group.

Rove's top donors in September included Texas billionaire Harold Simmons, who gave $2.5 million and Oklahoma coal baron Joseph Craft III, who gave $1 million. Another $1.32 million was donated by the Armstrong Company, a Pennsylvania conglomerate which provided the donation as "in-kind cable access, and $1 million from Jay Bergman, an Illinois oilman.

Meanwhile, Priorities USA Action, the pre-eminent Obama-supportive super PAC, said it raised a record $15.3 million.

"People who support the president know that we've come too far to go back now," Priorities senior strategist Bill Burton said. "We're ahead a little bit now, but it is time to close the deal."

Both campaigns and super PACs have made an all-out push for contributions as Election Day quickly approaches. The contributions are funding a record-breaking campaign operation for both candidates, which translates to paying a legion of campaign staff and hundreds of millions of dollars' worth of television ads.

So when it came to contributions directly to Obama's campaign, business owners and some Wall Street types helped pick up the tab, even if they didn't make up a majority of total contributions. Obama's donors in September included more than 4,000 CEOs, records show, and his campaign continued to tally millions pouring in from key battleground states.

Yet Obama hardly has a lock on winning the financial fight.

Republican super PACs have helped to match or exceed Obama's TV ad spending in dozens of media markets in battleground states. Ad spending data obtained by the AP from April through early October found pro-Romney spending has exceeded pro-Obama ad spending by at least $65 million across the nine states expected to decide the election: Colorado, Florida, Nevada, New Hampshire, North Carolina, Ohio, Virginia, Iowa and Wisconsin.

Obama broke presidential fundraising records four years ago, but has found himself financially outgunned for much of the summer, thanks in part to super PACs supporting Romney. Meanwhile, an AP review of campaign data this fall found Obama out-raising Romney in most of the 11 states that at one point were pivotal to win the election.

Reports detailing revenues and expenses for the first half of October are due to the Federal Election Commission by Oct. 25. Those will provide the public with the last financial snapshot before the Nov. 6 election.

Fire destroys State Fair of Texas icon Big Tex

DALLAS (AP) ? Big Tex, the metal cowboy whose slow drawl of "Howdy, folks!" made him an icon of the State Fair of Texas for 60 years, was destroyed Friday when flames engulfed his 52-foot-tall frame.

Some material that made up Big Tex's hands and sleeves could still be seen as firefighters gathered around the scorched area. This year's fair, which closes Sunday and had been celebrating the towering structure's birthday, went on despite the fire ? just as Big Tex would want it.

"Big Tex is a symbol of everything the state fair stands for," fair spokeswoman Sue Gooding said. "Big Tex is where my parents told me, 'If you get lost, meet at Big Tex.'"

The cowboy always was easy to spot, with his 75-gallon hat and 50-pound belt buckle.

Gooding said she didn't know what caused the fire, but noted that electrical controls move Big Tex's mouth and head. A Dallas fire spokesman didn't immediately respond to messages seeking comment.

Bill Bragg, the voice of Big Tex who read scripts from a nearby trailer while the giant cowboy's mouth moved, said someone came in and told him the structure was on fire. He stepped outside the trailer and watched Big Tex burn.

"It was a quick end," said Bragg, who is a radio engineer outside the three weeks a year that he works at the fair.

Several Big Tex backers say he will return next year, including Dallas Mayor Mike Rawlings, who tweeted that the icon would be rebuilt "bigger and better for the 21st Century."

"My job is safe and secure," said Bragg, who has been the man behind Big Tex for 11 years. "They're telling me, 'Take the rest of the day off and we'll see you next year.'"

Big Tex's hands, boots and face were made of Fiberglas, Gooding said. Most of his clothing was provided by a Fort Worth retailer. Gooding said the steel structure that held all the material will be evaluated, and a new one will be built if necessary.

The structure was removed later Friday in essentially the same way workers put it up every year ? with a crane that slowly lowers it. Only this time, the steel skeleton was covered with a tarp and taken away in almost a funeral-like procession.

Stanley Hill, who supervises a food stand that has been located near the structure for 18 years, said he noticed smoke coming from Big Tex's neck area and then watched for about 15 minutes as the giant cowboy burned.

"I couldn't believe it," Hill said.

No one was injured in the fire, Gooding said.

Big Tex was actually built in 1949 as a giant Santa Claus for a Christmas celebration in Kerens, 60 miles south of Dallas. Intrigued by the idea of a towering cowboy, the State Fair paid $750 for the structure, which debuted as Big Tex in 1952.

Big Tex is inextricably linked to the State Fair. The State Fair website is www.bigtex.com and visitors to the site see their cursor turn into an image of Big Tex's head, clad in a cowboy hat. The fair's Twitter account features the cowboy's image as well.

Chelsea Thornton's slaying of children points to need for mental ...

After Chelsea Thornton, a woman with a history of mental instability, shot her 3-year-old son in the head and drowned her 4-year-old daughter in a bathtub Wednesday, the local mental health community was left searching for answers as to whether, and how, such a tragedy could have been prevented.

"I place the blame on our mental health system for this tragedy to happen," said Cecile Tebo, a crisis-intervention specialist and the former commander of the New Orleans Police Department's Crisis Unit.

Thornton, 23, who suffered from schizophrenia and bipolar disorder, had recently stopped taking her medication, according to her mother, Eleanor Chapman. Thornton's best friend, Oblique Weavers, said Thornton had been hospitalized, and at times shackled to a bed, for a month at Southeast Louisiana Hospital in Mandeville about a year ago after having a mental breakdown that caused her to defecate on herself.

"If you go to a psych ward and you're s--ing on yourself, how are you going to let her come back home? Why didn't you keep her?" Weavers said Thursday. "Chelsea reached out for help so many times. The people kept sending her home. Some help could've saved the children."

The fact that a parent is committed to a mental institution does not automatically get child protection services involved, said Trey Williams, a spokesman for the state Department of Children and Family Services. Williams said Saturday that DCFS had never had any involvement with Thornton or her children.

According to Weavers, Thornton had been known to snap, "turning into a different person in a moment." During her episodes of depression, she at times locked herself and her children inside for entire days.

Just days before Wednesday's slayings, Thornton told Weavers she wanted to return to Southeast Louisiana Hospital or another mental institution. "I guess she felt like she was starting to lose it," Weavers said.

At that point, Thornton should have taken herself to a hospital, said Meghan Speakes, spokeswoman for the state Department of Health and Hospitals. Regardless of whether she had insurance or could pay, she would have received treatment, Speakes said. "If she had walked into any hospital and said, 'I want to kill my kids' or 'I want to kill myself,' she absolutely wouldn't have been allowed to leave the hospital," Speakes said.

But even if services are available for those with urgent needs, Thornton's story does raise the question of how she, and others like her, can slip through the cracks in the area's outpatient mental health system once they are released from a mental hospital.

"This is what, for years, people like me, along with others in the profession, have been screaming about," Tebo said. "The consequences of having fragmented, insufficient care for chronic mental illness are deadly."

Since January 2008, when Bernel Johnson, a man with a long history of institutionalization and severe mental illness, killed NOPD officer Nicola Cotton, psychiatric hospitals have developed better plans for people once they are released back into the community, said Calvin Johnson, executive director of the Metropolitan Human Services District.

When people are released from Southeast Louisiana Hospital, for example, they leave with a referral to outpatient care, he said. Additionally, if patients need intensive assistance in the community, they are often referred to one of three "assertive community treatment" teams run by Johnson's organization. Those teams, made up of social workers, psychiatrists and others, can help up to 300 people with mental illness navigate in the outside world.

An "intensive case management team" offers similar services for an additional 175 patients.

"In most instances there are slots available," Johnson said. He said he couldn't address whether Thornton ever sought assistance through a district program because of federal privacy laws. But friends and family members said they were not aware that Thornton was cared for by such a team.

More critically for relatives of people in crisis, the district six months ago started a "crisis response team" that specifically responds when patients fail to take medication or need direct intervention. "If she was not taking medication, that team of people could have done the necessary things to get medication to her," Johnson said.

The same unit also has five "respite beds" available at a facility on Tulane Avenue where people can get inpatient treatment, he said. Assistance is available by calling 504.826.2675.

"We have resources," Johnson said. "But we haven't done a good job in making people knowledgeable about those resources."

Dr. Elmore Rigamer, a psychiatrist with Catholic Charities, agreed that there are better mechanisms in place now to refer patients to outpatient services when they are discharged from mental hospitals. But he said those referrals remain imperfect, as the follow-up appointment often does not come until two or three weeks later.

Some patients need to be aggressively pursued to make sure they continue treatment after hospitalization, Rigamer said. That might not be in place for all patients leaving hospitals, he said.

"You really have to be proactive with really fragile people. You can't just discharge them," he said. "You have to have a case manager that sticks to them like flypaper."

Tebo said in-patient beds in metropolitan New Orleans have decreased by 60 to 70 percent since Hurricane Katrina.

While it is not clear Thornton was ever denied care, that decline in available beds has "raised the bar" as to who is admitted to a hospital, leaving many out, Tebo said. She said that problem will likely be exacerbated when Southeast Hospital closes due to the state's current round of Medicaid cuts.

Speakes, however, said that assertion was "ridiculous" because even though Southeast's building is expected to be vacated by Dec. 31, all of its mental health beds will be transferred to private hospitals, many of?them in New Orleans. The state is still in the process of determining where the beds will go, she said.

In the days leading up to the killings, Thornton's friends and neighbors said, they noticed she was acting strangely. However, no one called any authorities to report her behavior because they never suspected that Thornton, who had no criminal record and no history of violence, would have been capable of committing such acts.

Stella Adams, an aunt of Thornton's children on their paternal side, said she was horrified about two years ago to learn that Thornton was living with her children in a house where there were drugs. Deciding to forgo part of her own income, Adams said, she insisted on moving the family into one of her rental properties without charging them for it.

But even though some family members said they were concerned for the welfare of Thornton's children, it appears no one ever filed a valid complaint of child abuse or neglect with state child protection services.

"We have never had any prior history with this family," said Trey Williams, the DCFS spokesman.

That type of inaction, while common, can be deadly for children, said Dr. Catherine Taylor, a Tulane University public health professor. Especially in cases of child abuse, people outside the family tend to "diffuse responsibility" from themselves, assuming that if the problem is really serious, someone else will step in, Taylor said.

"This tragic event, sadly like many other stories of child abuse, is plagued by a belief in the privacy of the family bubble -- whatever goes on within families is nobody else's business," Taylor said in an email message.

"In fact, when it comes to the health, well-being and, in this case, survival of children, it is everyone's business," Taylor said. "If a parent that is struggling reaches out for help, seems isolated and stressed, or seems to be losing it, family, friends and community need to step in."

Anyone suspecting a mental health patient has been off their medication or is in need of services can call either of two 24-hour crisis hotlines managed by professionals. The statewide number is 211. The Metropolitan Human Services District manages another hotline at 504.568.3130.

Do you ever wonder what will prevent another company from using your business name? How about if you?re legally permitted to use the name you picked for your business? Or do you know when you can use the TM symbol with your brand or product name?

Assembled here are all the answers to the most frequently asked questions when it comes to trademarking. If you?re a small business owner, read on to learn more about the trademark, and most importantly, if you need one for your business.

What is a trademark??

A trademark is a word, phrase, symbol, or design (or a combination of any of these) that identifies the source of a product or service and distinguishes it from competitors.

What can be trademarked??

Trademark registration can be granted on distinctive names, logos and slogans. You might want to seek a trademark for a product name, company name, company logo, or tagline.

For example, ?Nike?, the Nike swoosh design, and ?Just Do It? are all trademarks owned by Nike to distinguish their products from other athletic companies. But keep in mind that trademark protection only applies to a particular category of goods and services. Nike Inc. may own the mark on a variety of shoes, clothing, sporting goods, etc. But there?s also a Nike Corporation in Sweden that?s involved in heavy machinery, like hydraulic lifting jacks.

What?s the difference between a registered and unregistered trademark??

Trademarks don?t actually have to be registered with the USPTO (US Patent and Trademark Office). If your company creates a logo or name that you want to use exclusively, you can attach the TM symbol and this essentially gives you ?common law? rights.

However, trademarks that are registered with the USPTO enjoy stronger brand protection (see ?What are the benefits of registering a trademark?? below)

Also keep in mind that in order to claim first use to a name, the name has to be ?trademarkable? (i.e. not already in use by someone else) and needs to be in use in commerce. For example, if you think of a cool company name, you will need to actively market and sell a product or service using that company name for your common law trademark to be valid.

How do I know if a name is available for me to use for my company, product, or service? ?

Before you incorporate or register your business with your state, you?ll need to check the state?s database of company names and make sure the name you want isn?t already in use. Name conflicts are one of the main reasons many LLC, corporation, or DBA applications get rejected. At this point, you should also conduct a free trademark search to check if your business name is available to use at the federal level.

It?s also important to know that you can still infringe on someone else?s mark even if they?ve never formally registered it with the USPTO. For this reason, you should also run a comprehensive nationwide trademark search into state and local databases (beyond just your own state). This should include common law and county registrars.

When should I or can I use the trademark symbol? And what?s the difference between TM and ??

Before you have registered a trademark with the USPTO, you may use the TM symbol. After a trademark is registered with the USPTO, you have the right to use ? in your trademark. Many companies choose to use the TM or ? symbol with the first appearance of the company or product name in a document, and then drop the symbol for each appearance after that.

What are the benefits of registering a trademark??

By registering for U.S. Federal Trademark protection, you?ll be eligible for several benefits, including:

  • Treble damages in some cases of infringement
  • The right to use ? in your trademark
  • A streamlined process for securing your domains and usernames at social sites like Facebook, Twitter, and YouTube
  • Significantly stronger protection than ?common law? (aka. unregistered) marks. This can make it much easier to recover your property, let?s say if someone happens to use your company name as their Twitter handle.

If I?ve already registered my name with the state, do I still need a trademark??

When you incorporate, form an LLC, or file a DBA (Doing Business As) for your new business, this process registers your business name with your state?s secretary of state. Before approving your application, the state checks that your name is distinguishable from all other business names registered in the state. Once approved, the business name is yours, and yours alone, to use within the state. This prevents anyone else from using your name within your state, but it doesn?t offer any kind of protection in the other 49 states.

If you?ve started a business that?s physically tied to your state (i.e. a hair salon or restaurant) and have no plans on expanding into other states, registering your name with the state or county might be enough brand protection for you. However, if you?re planning on conducting business outside your own state (i.e. you sell a product or you provide services and some of your clients may live elsewhere), you should look into trademark protection with the USPTO.

How are trademarks registered and how much does it cost??

To register your business name, you?ll need to file an application with the USPTO: you can file either directly with the USPTO or have an online legal filing service handle it for you. Expect to pay approximately $325 per class in application fees that your mark would fall under and the process can take anywhere from 6-12 months once you submit your application.

It?s also smart to perform a comprehensive trademark search before starting the application process to make sure your name is available (you won?t get an application refund just because your name isn?t available).

While the process of registering a trademark is more involved than registering a DBA, rights to your name will be enforced by both the federal and state governments. As you?re getting your company off the ground, remember that your name represents your brand and business, so take the right steps up front to protect your identity.

2. Slow down the trot. Ride on really low throttle and when you are able to sit easily, step on the gas in two stages, just a little bit at a time. Slow down once again.

3. Get the pony on the bit while at a posting trot. When your horse is round, sit quiet for 2 or 3 strides. Get to posting once more, before you surrender to the desire to use your legs to grip your horse. Set your body right, relax the legs and again sit quiet for two or three strides.

4. Cross the stirrups over at the saddle?s front. Do posting without using the irons until your legs tire. You?ll be unable to grip with tired legs, and that will make you sit deeper.

5. Concentrate on your own hips. Take note of the way they close and open on the walk. Try and imitate that exact motion on the sitting trot.

6. Make believe you are a practiced belly dancer. Swivel your hips.

7. Grip the saddle?s front with the inside hand. Using that very same hand, pull yourself more deeply into your saddle. This way, you will be able to experience the feel of sitting in sync with your horse on the sitting trot.

Abortions never necessary to save mother's life, says Rep. Joe Walsh

Republican Congressman Joe Walsh of Illinois said after his Thursday debate against Democratic rival Tammy Duckworth that abortions are never necessary to save a pregnant woman's life, because modern technology has eliminated the risks of childbearing.

Walsh was defending his position that abortion should be outlawed with no exceptions, which is also the Republican Party's official stance on the issue.

"With modern technology and science, you can't find one instance" of a pregnant woman's life being at risk, he told reporters after the debate.?"There is no such exception as life of the mother, and as far as health of the mother, same thing." He added that "advances in science and technology" meant that abortion is never necessary for the health of a mother.

Walsh, a freshman Congressman, is currently trailing Duckworth, a veteran of the Iraq War, in the polls.

In August, Republican Senate candidate and sitting Congressman from Missouri Todd Akin told a reporter that he didn't support exceptions for abortion for rape because women's bodies have a mechanism to prevent pregnancy in the case of a "legitimate rape." Mitt Romney and many national Republican politicians quickly distanced themselves from Akin and his comment. Romney has said he supports abortion exceptions in the cases of rape and the mother's health.
